Tariff for administrative and tax cases

For preparing a written objection to the act of administrative violation – 100 levs, but not less than 50 levs page of objection.

For preparing a criminal complaint against the ruling or appeal against the judgment at first instance, without appearing in court fee is 5% of the amount of the penalty, but not less than 150 levs and not less than 50 levs page of appeal .
The consideration paid for the objection is deducted.

Participation of the lawyer at the hearing should be paid 150 levs meeting.

For legal representation, protection and assistance in administrative and tax cases with a material interest in one instance, the remuneration is on average 4% interest and is calculated using the following scale:

1. in rhe interest in 1000 leva – 300 leva;
2. in the interest from 1000 to 5000 leva – 300 leva plus 7% of the amount above 1000 leva;
3. in the interest in 5000 to 10 000 leva – 580 leva plus 5% of the amount above 5000 leva;
4. in the interest of 10 000 to 100 000 leva – 830 leva plus 3% for the amount above 10 000 leva;
5. in the interest from 100 000 to 1 million leva – 3530 leva plus 1% for the amount above 100 000 leva;
6. in the interest in 1 million to 10 million leva – 12 530 leva plus 0.3% of the excess over one million leva;
7. in the interest over 10 million leva – 39 530 leva plus 0.1% for the amount above 10 million leva.

That remuneration shall also apply to the administrative appeal of tax acts and other administrative appeals are mandatory before judicial review.

In the tax assessment proceedings to challenge the Tax Act and any appeal by administrative order is paid once compensation as pay his objection, new is not due to the award of administrative appeal.

That remuneration includes preparing documents such as requests, complaints, objections or appeals and opinions on acts of administrative authority and submission in court, drafting of pleadings before the court, and the appearance of two hearings for cases with interest over 20 000 lev.
For each subsequent meeting and deeds in this interest of every hearing shall be paid additional remuneration to appear in court.

For preparation of procedural documents for the court without appearing in court in cases with more than 20 000 lev interest remuneration is reduced by 20%.

FOR NEXT INSTANCE, if the lawyer was paid for previous instance the remuneration for the preparation of papers is 25% lower than the remuneration of first instance, which is not the remuneration for appearing in court, and can not be less than 600 lev in cassation and revocation proceedings of a final decision.

In the event that the lawyer not involved in the preparation of papers for the previous instance, the remuneration for the next instance is the remuneration for the first instance.

To re-signing of procedural papers for the court when not prepared by countersign lawyer salary is reduced by 30% but can not be less than 300 lev, while an appeal or response to an appeal at least 600 Levs.

For cases with interest over 100 000 lev fee includes appearing in all hearings, irrespective of their number.

Administrative and tax cases is permissible to negotiate and additional remuneration as a percentage of the amount won by a final decision, which may not affect the due advance minimum royalty.

For legal representation, protection and assistance in administrative matters without material interest: the minimum wage for an application, complaint or other securities to an administrative body – 300 lev plus 50 lev per page for each page above the heel.
This fee applies to all claims, objections and private complaints outside of the main proceedings.

For representation, protection and assistance in administrative matters specific minimum wage is:

1. for cases under the Spatial Planning Act and the Cadastre and Land Registry – 600 leva;
2. for cases under the Social Security Code – 350 leva;
3. for cases under the Ministry of Interior – 400 leva;
4. for cases under Bulgarian State Standard – 350 leva;
5. for cases under Chapter Eleven of the Public Procurement Act – 500 Levs.
